SOFTWARE THEFT:
UNAUTHURIZED USED OF ANY OF OUR PRODUCTS / SERVICES IS
AGAINST THE LAW. Any violation of our policy for any person(s),
individual(s), businesses(s) whether Private; Commercial or Non-Profit
will be held responsible for all cause. All our products and services
communicates with our servers for updates. No parts of the script,
software, any services may be reproduced, posted, stored, distributed,
displayed, published, broadcasted, transmitted or printed at all.
Unauthorized Use of any of the scripts, software, products and services
will leave us no choice but to take FULL FORCE LEGAL ACTION against
you, your business, your partners and your services if our demands
are not met.
TERMS OF SCRIPT USE:
By purchasing any of our products, does not indicate you the ORIGINAL
owner. TarkTech Solutions has the right to seize any property that
is misused in any other form.
You will not change, edit or reuse the Traffic Booster Script in
more than ONE web site. Every additional web site. use will only
be permitted by purchasing another license for a lower price other
than the original price of the script for other web sites.
INSTALLATIONS:
Installation is Your responsibility unless you advise TarkTech Solutions
for the installation. An extra charge is applicable for the Labour
and Installation Process.
TERMS AND CONDITIONS OF USE (EULA)
END-USER LICENSE AGREEMENT:
This End-User License Agreement ("EULA") is a legal agreement
for Search Engine Traffic Booster, which includes computer software
and may include associated media, printed materials, and "online"
or electronic documentation (collectively the "Software Product"),
between you ("User") and TarkTech Solutions. By accessing,
installing, copying, or otherwise using the Software Product, you
agree to be bound by the terms of this EULA. If you do not agree
to the terms of this EULA, you may not install, distribute, or use
the Software Product; you must delete it from your system entirely.
COPYRIGHT. The software products are protected by copyright and
international laws. All title and copyrights in and to the Software
Product (including but not limited to any images, photographs, keyword
lists, IP lists, source code (uncompelled Perl script), incorporated
into the Software Product) are owned by TarkTech Solutions.
GRANT LICENSE. The Software Product is licensed,
not sold. Subject to the condition that you are in compliance with
the terms of this EULA, you may install and use the Software Product
FOR USE FOR YOUR PERSONAL PROMOTION OF 1 DOMAIN OR URL THAT IS DIRECTLY
OWNED BY YOU OR FOR WHICH YOU ARE AN AFFILIATE. YOU MAY PURCHASE
ADDITIONAL LICENSES FOR YOUR USE (FOR YOUR DOMAINS ONLY) FROM WITHIN
THE MANAGEMENT CONSOLE. No other use, modification, alteration,
copying, or distribution of the Software Product is permitted. You
may not rent the Software Product, nor may you offer use of it to
others through a service bureau or application service provider.
If you are installing this copy of the Software Product as an upgrade,
update, patch or enhancement of a prior release of the same Software
Product which was installed on the same computer, your rights under
the prior license agreement for the Software Product are terminated,
and all of your use of the Software Product (including its prior
versions) are solely under the terms of this license agreement.
MODIFICATION SOFTWARE. You may not alter, modify,
or change Software Product source code files in any manner, except
as specified in the installation process of TarkTech Solutions.
LIMITATIONS. Except to the extent such a restriction is unenforceable
under local law, you may not reverse engineer, recompile, or disassemble
the Software Product. The Software Product is licensed as a single
product, and its component parts may not be separated for use on
more than one computer. You may not modify, amend, or create derivative
works of the Software Product.
DOMAIN LICENSES. This Software Licenses grants
you a single Domain License, allowing you to use Search Engine Traffic
Booster on a single domain. You may purchase additional Domain Licenses
for your use. You may not resell, grant, or give these Domain Licenses
to others, as they are only for your use on domains you own or control.
Doing so will results in the termination of your product/service
by TarkTech Solutions without any proper notification. Reusing The
Software in two different Domains will complicate the Search Engine
Ranking Terms and may cause for the script to not perform properly
as to the Domain Name Registered with the software is not the same
as the INSTALLED DOMAIN.
REUSING ONE USER LICENSE TRAFFIC BOOSTER IN MORE THAN ONE DOMAIN
WILL CAUSE YOUR WEB SITE BEING BANNED FROM THE SEARCH ENGINE DATABASE.
TarkTech Solutions is not responsible and will not be held responsible
for your misuse of Traffic Booster.
USE OF SOFTWARE PRODUCT. User is solely responsible
for use of software, and any and all results resulting from use
or misuse of software. It is your duty to ensure that you are using
software in accordance with all local, state, and national laws.
It is your duty to monitor pending and new legislation and make
sure you are in compliance. It is your responsibility to ensure
that your Web host/ISP allows installation and use of Software Product
on their systems, even if we do installation on said Web host/ISP.
You must use the product in an ethical and responsible manner. You
may not include keywords in the product that are unrelated to your
Web site.
TERMINATION. Without prejudice to any other rights,
TarkTech Solutions may terminate this EULA or your rights under
this EULA at any time if you fail to comply with the terms and conditions
of this EULA. Upon termination of your rights under this EULA for
any reason, or upon termination of the EULA itself, you must destroy
all copies of the Software Product and all of its component parts
in your possession (including all component parts, the media and
printed materials, any prior versions, and this EULA). The terms
of this paragraph shall survive any termination of this EULA. If
you request a refund of your purchase, you must destroy all copies
of Software Product within 14 Business Days.
PRIVACY. You understand and accept that Software
Product will communicate with TarkTech Solutions servers for upgrades,
updates, patches, and license verification. Information pertaining
to your installation will be communicated to TarkTech Solutions
servers solely for the purpose of license verification.
INDEMNIFICATION. User agrees to defend, indemnify
and hold harmless TarkTech Solutions and its shareholders, directors,
officers, employees, agents, affiliates, and any person or entity
involved in creating, producing, or distributing Software Products
from and against all claims and expenses, including attorneys' fees,
arising out of the installation of Software Product, use of Software
Product, misuse of Software Product, failure to use Software Product,
technical glitches or bugs or security weaknesses in Software Product,
or any other result arising out of Software Product.
DISCLAIMERS. User expressly agrees that use of
Software Product is at User's sole risk. You agree that Software
Product is provided "as is" and without warranties of
any kind either express or implied. You understand that use of Software
Product could result in significant recourse against you by the
search engines, including, but not limited to, your entire domain
name being banned and purged from search engine listings; you agree
to take sole responsibility for such results. You also understand
that installing this software on certain ISP's/Web hosts may result
in those ISP's/Web hosts banning you from their site, or taking
other action against you. You also understand and agree that, while
we make every effort to ensure that software does not contain any
security weaknesses, we are not responsible for any data loss, hacker
attacks, backdoors, Trojan horses, or other security or data incidents
resulting from use, installation, or misuse of Software Product,
or from our installation services, installation advice, or digital
or telephonic communications related to installation or use of Software
Product. To the fullest extent permissible pursuant to applicable
laws, TarkTech Solutions disclaims all warranties, express or implied,
including, but not limited to, implied warranties of merchantability
and fitness for a particular purpose. TarkTech Solutions does not
warrant that this site or its Software Product will be uninterrupted,
secure, error-free, bug-free, virus-free, or that defects will be
corrected. When we provide installation services, paid or otherwise,
via e-mail, on the telephone, or remotely, you understand that we
are not responsible for any data loss, compromised security, or
loss of profits resulting from installation services or advice.
As well, we do not warrant or guarantee that our installation services,
or that the Software Product, is not in violation of the Web Host’s
Terms & Conditions.
IMPORT EXPORT
All businesses, individuals and private owners are responsible for
Export payments and import charges. TarkTech Solutions, DesignStudio
Canada, ZeroMax Solutions and all it is affiliates does not take
any responsibility for export and import charges and their payments.
We, us, our company will not be held responsible for products, equipments
damaged through shipping. We do not deliver our equipment therefore
we do not accept any responsibilities for the shipment. Please arrange
your shipping ways to deal with the purchased equipment. All we
can offer is a free shipping charges. That applies only to purchases
over $2000.
TarkTech Solutions will not be held responsible for damages caused
while installing the software product without proper understanding
of the Host Server. TarkTech Solutions will not be held responsible,
if the damage or programming data or edited data is cause while
installing the software products. We/Us (TarkTech Solutions) do
not guarantee that the software product MUST work on all search
engines and TarkTech Solutions is not to be held responsible for
liable for any non-traffic caused by search engines and their affiliates.
This Software product will not cause any injuries to any human
being, individual, person, any living being, or any form of a living
organism. TarkTech Solutions does not authorize the use of this
product to be used against Search Engines and their affiliates by
cause any violation of the LAWS in the United States of America,
Canada, or any other International Bodies of LAWS. TarkTech Solutions
will not be held responsible when such an action is taken to violate
any United States LAWS, Canadian LAWS, and any other International
LAWS.
THIS DISCLAIMER OF LIABILITY APPLIES TO ANY DAMAGES OR INJURY

ITS EMPLOYEES, DIRECTORS, SHAREHOLDERS, AFFILIATED PARTIES, OR ANY
PERSON OR ENTITY INVOLVED IN CREATING, PRODUCING OR DISTRIBUTING
SOFTWARE PRODUCT ARE NOT LIABLE FOR THE DEFAMATORY, OFFENSIVE OR
ILLEGAL CONDUCT OF OTHER USERS OR THIRD-PARTIES AND THAT THE RISK
OF INJURY FROM THE FOREGOING RESTS ENTIRELY WITH USER. LIMITATION
LIABILITY. YOU AGREE THAT IN NO EVENT WILL TarkTech Solutions, ITS
EMPLOYEES, DIRECTORS, SHAREHOLDERS, AFFILIATED PARTIES, OR ANY PERSON
OR ENTITY INVOLVED IN CREATING, PRODUCING OR DISTRIBUTING SOFTWARE
PRODUCT BE LIABLE FOR ANY DAMAGES, INCLUDING, WITHOUT LIMITATION,
DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE
DAMAGES, OR ANY LOST PROFITS OR LOST SAVINGS -- EVEN IF WE HAVE
BEEN ADVISED OF THE POSSIBILITY OF SUCH LOSS, DAMAGES, OR CLAIM
-- ARISING FROM USE, MISUSE, OR INSTALLATION OF SOFTWARE PRODUCT
OR FROM INSTALLATION SERVICES OR ADVICE. THE FOREGOING LIMITATIONS
AND EXCLUSIONS APPLY TO THE EXTENT PERMITTED BY APPLICABLE LAW IN
YOUR JURISDICTION. USER HEREBY ACKNOWLEDGES THAT THE PROVISIONS

SOFTWARE BLAMELESS IN SUCH CIRCUMSTANCES. YOU REALIZE AND RECOGNIZE
THAT SEARCH ENGINE SPIDER PASSING ENTAILS SIGNIFICANT RISKS. YOU
FURTHER UNDERSTAND THAT TarkTech Solutions MAKES NO WARRANTIES,
GUARANTEES, OR CLAIMS IN REGARDS TO YOUR OUTCOME BY USING THIS SOFTWARE.
WE DO NOT GUARANTEE THAT YOU WILL BE LISTED IN THE SEARCH ENGINES,
OR THAT YOUR LISTINGS WILL INCREASE. YOU RECOGNIZE THAT IT IS DIFFICULT
TO GET HIGH-PROFILE SEARCH ENGINE LISTINGS. YOU RECOGNIZE THAT IT

User is responsible for ascertaining whether or not Software Product
violates any state, local, regional, or federal laws, in Canada,
the United States or Internationally.
MONEY BACK POLICY: All sales are final for all
computers and computer accessories. No exchange or return. Warranty
is given by the manufacturer. Warranty ranges from 1 year to 3 years.
Or warranty can be purchased for an extended period of time.
This Agreement constitutes the entire agreement of the parties with
respect to the subject matter hereof, and supersedes all previous
written or oral agreements between the parties with respect to such
subject matter. This Agreement shall be construed in accordance
with the laws of the State of Oregon. No waiver by either party
of any breach or default hereunder shall be deemed to be a waiver
of any preceding or subsequent breach or default. The section headings
used herein are for convenience only and shall not be given any
